Racing Manager 26

These Terms of Service ("Terms") govern your use of the mobile game Racing Manager 26 ("the App") on Apple iOS (App Store) and Android (Google Play). By downloading, installing or using the App you agree to these Terms. If you do not agree, please do not use the App.

1. Who We Are

The App is developed and published by Boris Sobat, an individual developer operating under the name "Virtus et Honos" ("we", "us", "our").

2. License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use the App on devices you own or control, for your own non-commercial entertainment. This license is also subject to the terms of the store you obtained the App from (Apple Media Services Terms or Google Play Terms of Service). All rights not expressly granted to you are reserved by us.

3. Age Requirement

The App is intended for users aged 13 and older. If you are under the age of majority in your country, you may use the App and make purchases only with the permission of a parent or legal guardian.

4. In-App Purchases

The App is free to download and may offer optional in-app purchases, such as:

• —Pro — a one-time upgrade that unlocks extra features and removes ads.
• —GP coin packs — consumable in-game currency.
• —Pro bundle — Pro together with a coin pack.

All payments are processed by the Apple App Store or Google Play. Prices are shown in the store before you confirm a purchase. We never receive or store your payment details.

Purchased content is delivered immediately after the purchase is confirmed. By confirming the purchase you request immediate delivery of digital content and acknowledge that, where the law allows, you lose your statutory right of withdrawal once the delivery has started.

Refunds are handled by Apple or Google in line with their refund policies. Your statutory rights as a consumer, including rights regarding faulty digital content, are not affected. If a purchase was not delivered or does not work, contact us at softwarevirtusethonos@gmail.com and we will help resolve it.

5. Virtual Items

The in-game currency ("GP coins") and other virtual items in the App have no real-world monetary value. They cannot be exchanged for real money, transferred to other players or sold, and they can only be used inside the App. You receive a license to use them, not ownership.

One-time purchases (such as Pro or content packs) are linked to your Apple or Google account and can be restored with the Restore Purchases option. Consumable items (such as coins) are used up when spent and cannot be restored.

6. Game Progress and Saved Data

Game progress, settings and in-game currency balances are stored locally on your device. We do not keep a copy on our servers, so deleting the App, clearing its data, resetting or losing your device may permanently delete your progress. We are not able to recover lost local data.

7. Advertising

The free version of the App shows advertisements provided by Google AdMob. Some ads may be optional rewarded ads that give an in-game reward for watching them. We are not responsible for the content of third-party ads or for products and websites they link to. How ad data is handled is described in our Privacy Policy.

8. Acceptable Use

When using the App you agree not to:

• —copy, modify, decompile, reverse engineer or redistribute the App, except where the law expressly allows it;
• —use cheats, hacks, modified versions of the App or tools that manipulate game data, purchases or ads;
• —obtain paid content without paying for it, or abuse refunds;
• —use the App for any unlawful purpose.

9. Intellectual Property and Fictional Content

The App, including its code, design, graphics, text and sounds, is owned by us or our licensors and is protected by copyright and other laws.

The App is a work of fiction. Teams, riders, drivers, manufacturers, series and events in the App are fictional or used only in a descriptive way. The App is not affiliated with, endorsed or sponsored by any real racing championship, organiser, team, manufacturer or person.

10. Updates and Availability

We may update, change or remove features of the App, publish updates automatically, or stop offering the App. We will try to keep paid one-time features working for as long as the App is available, but we do not guarantee that the App will be available at all times, on every device, or without errors.

11. Disclaimer

Apart from any rights you have under mandatory consumer law, the App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for loss of data or game progress, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App and in-app purchases in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent, gross negligence, or death or personal injury.

13. Termination

You can stop using the App at any time by uninstalling it. If you seriously breach these Terms (for example by using cheats to obtain paid content), we may suspend or end your license to use the App.

14. Apple-Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. Continuing to use the App after a change means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the developer's country of residence. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. EU consumers can also use the EU online dispute resolution options available in their country.
